Right to Rent checks
England · last checked 8 October 2026
You must check that every adult who will live in the home has the right to rent in England. Check everyone the same way, so you don't discriminate.
Do
- Check original documents, or use the Home Office online share code, before the tenancy starts.
- Keep a dated copy of what you checked for the whole tenancy and one year after.
- If someone's permission is time-limited, do a follow-up check before it runs out.
Don't
- Don't only check people you think "look foreign". That is discrimination.
- Don't let an adult move in before the check is done.
Deadlines
- First check
- Before the tenancy starts
- Follow-up check
- Before their permission ends
If you get it wrong
Up to £5,000 per occupier for a first breach and £20,000 for repeats. Knowingly renting to someone without the right can be a crime.
